Death Row Man: I'm Too Fat To Die

A death row inmate scheduled for execution in October says he should be spared the death penalty because he is so fat that executioners would have trouble finding his veins.

Lawyers for Richard Cooey are arguing in a federal lawsuit that Cooey had poor veins when he faced execution five years ago and that the problem has been worsened by weight gain.

The lawsuit says Cooey is 5ft 7in tall (1.7 metres) tall and weighs about 270 pounds (122 kilograms).

It also claims that a drug Cooey is taking for migraine headaches could diminish the effectiveness of the first of three drugs Ohio uses in its execution process.

Cooey was sentenced to death for raping and murdering two female University of Akron students in 1986.

His execution is scheduled for October 14, when he would become the first person put to death in Ohio since Christopher Newton was executed last year for killing a cell mate over a chess games.

It would also be the first execution in Ohio since the end of an unofficial national moratorium on executions. Since the Supreme Court upheld the intravenous injection procedure in April, 16 inmates have been executed around the country.

Dr Mark Heath, a medical expert hired by the Ohio Public Defender's Office, said Cooey's use of the drug Topamax, a type of seizure medication, may have created a resistance to thiopental, the drug used to put inmates to sleep before two other lethal drugs are administered.

He also said Cooey's weight, combined with the potential drug resistance, increased the risk he would not be properly anaesthetised.

Cooey's lawyer, Kelly Culshaw Schneider, said: "All of the experts agree if the first drug doesn't work, the execution is going to be excruciating."

Cooey is not the first US death row inmate to try to get out of his impending execution by virtue of his weight. But previous cases do not bode well for him.

In 1999, lawyers for condemned killer Allen Davis argued the voltage in the electric chair fell short of the amount needed to kill painlessly, especially for someone who was overweight.

During Davis's execution in Florida, blood poured from his face in what officials said was a nosebleed that happened after he died.
